We are now accepting Contingent Decision Claims from members for review, the claim form should be completed and sent to [email protected]
Ideally, contingent decision claims should be submitted by 30th September 2024, although in exceptional circumstances claims may be reviewed after this date.
A Contingent Decision is a decision taken by a Member, that would have been different had it not been for the discrimination identified by the courts. The decision will relate to membership of the Police Pension Scheme during the Remedy Period 1 April 2015 to 31 March 2022.
There are three types of Contingent Decisions for which a claim can be made:
1. Opt-Outs:
A Member who would not have opted-out if they had been allowed to remain in the Legacy Scheme beyond their transition date, or,
A protected Member who had not been allowed to join the 2015 Reformed Scheme from 1 April 2015.
2. Honoraria:
A Member who would have chosen an Honoraria (Non-Pensionable Payment) if they had remained in the Legacy Scheme.
3. Additional Service:
A Member who would have purchased (more) additional service if they were in the Legacy Scheme.
In all cases the member must provide a short statement in their own words to confirm the decision that was made, the reasons for the decision and what they would have done differently had the discrimination not occurred.
